PART 1 — AGREEMENT CLAUSES


  1. Nature, Definition & Scope


    1. The premises remain in possession and control of NAVKAR ESTATES.


    2. This Agreement creates no tenancy interest, leasehold estate or ownership right.


    3. The Tenant receives a personal, non-transferable licence to occupy the allotted unit under these terms.


  2. Validity & Termination


    1. Agreement remains valid for the stated term; renewal charges may vary per market rate.


    2. Failure to renew after expiry → unauthorised stay / trespass under Maharashtra Rental norms.


    3. Either party may terminate at the end of the term with 1 month’s written notice.


    4. For material breach, management may terminate with 1-day notice.


    5. Termination does not release Tenant from pending liabilities.


  3. Owner’s Rights & Services


    1. NAVKAR ESTATES provides accommodation access; relocation may occur during emergencies.


    2. Management may enter the room for inspection, repair or safety reasons; prior intimation will be given where possible.


  4. Zero Deposit / Eqaro (If Applicable)


    1. Tenant must complete and renew Eqaro Rent Bond on time.


    2. Failure allows NAVKAR ESTATES to demand full deposit or evict.


  5. Confidentiality


    Agreement terms are confidential; disclosure only as required by law. This clause survives termination.


  6. Governing Law & Jurisdiction


    This Agreement is governed by Indian laws; Mumbai courts hold exclusive jurisdiction.


  7. Compliance & Prohibited Conduct


    1. Tenant must comply with all laws.


    2. Strictly prohibited: ragging, illegal activities, cyber-crime, weapons, drugs, nuisance, disturbance, damage, harassment, possession of contraband.

    3. Any violation = material breach + immediate eviction rights.



  8. Complaints & Dispute Resolution


    1. All complaints must be raised via Tenant App (EazyPG).


    2. If unresolved within 2 working days, escalate to management.


    3. Complaints do not justify withholding rent or utilities.



      PAYMENTS, DEPOSITS & COLLECTION


  9. Payment Mode & Receipts


    1. All dues payable only through Tenant App or exclusive payment link.


    2. Cash accepted only via OTP-verified official method.


    3. Digital receipt auto-generated.



  10. Auto-Pay (MANDATORY Clause)


    1. Auto-Pay is compulsory from joining till eviction.


    2. Disabling, rejecting or delaying Auto-Pay = Payment Default.


    3. Consequences:


      Security Deposit may be treated as ZERO for recovery Manual collection, telecaller & legal charges Repeated default → eviction + legal action


  11. Utility Bills & Services (Tenant Responsibility)


    Tenant must pay:


    Electricity WiFi

    Maid charges Gas

    Water, parking, maintenance & other utilities


    Default → immediate suspension of service without notice.



  12. Late Payment & Bounced Cheque


    Late fee up to 1,000 per day after due date.


    Bounced or declined payment: 1,500.



  13. Security Deposit — Return & Forfeiture


    1. Deposit returned only after:


      Full dues settlement Valid notice

      Key handover Inspection

      Evidence submission through App Process timeline: 45 working days

    2. Deposit forfeiture applies if:


Tenant leaves before lock-in completion Invalid notice

Material breach


Damage beyond normal wear & tear


Deposit cannot be adjusted towards rent unless authorised via written approval.



PART 2 — HOUSE RULES


  1. Tenant App Rules


    1. Mandatory for KYC, joining form, police verification.


    2. All payments, notices, receipts and complaints through the App only.



  2. Notice, Checkout & Eviction


    1. Valid Notice: Only on rent cycle date (+3 days grace).


    2. Invalid Notice = Deposit Forfeited.


    3. Cancellation within 15 days subject to new booking.



  3. Check-in Timings


    11 AM – 7 PM with prior intimation.



  4. Guests & Visitors


    No visitors allowed (family/friends/colleagues).


    Violation fine: 5,000 + immediate eviction + deposit forfeiture.



  5. Daily Cleaning — Mandatory


    Daily maid cleaning is compulsory; charges added to monthly bill.



  6. CCTV & Security Rules


    Do not cover, switch off or unplug CCTV. Fine: 2,000 per instance.

    If CCTV/Wi-Fi is off → Tenants responsible for any theft/mishap.



  7. Room & Common Area Rules


    Maintain cleanliness, store food properly.


    No furniture movement or wall drilling without permission. Lost key replacement: 1,000.


  8. Damage, Repairs & Vandalism


    Any damage or vandalism → chargeable + possible eviction.



  9. Appliances & Electricity


    High-wattage appliances prohibited in non-metered rooms. Leaving lights/taps on → 500 fine.

    Backup power restrictions apply for AC/geyser/washing machine.



  10. Prohibited Activities


    Smoking/Drinking: 5,000 per instance.


    Drugs, ragging, gambling, harassment, loud music prohibited. Quiet hours: 10 PM – 8 AM.


  11. Deliveries


    Delivery agents allowed only till reception.



  12. Parking


Parking allowed only with written permission.



PENALTIES & CHARGES (SUMMARY)

MOVE-OUT CONDITION & DEDUCTION CLAUSE


Tenant must return the premises in the same good, clean and functional condition as provided. Charges apply for:

Cleaning Painting Damages Missing items Repairs

Deep cleaning


Applies to: walls, paint, kitchen trolley, AC, fridge, washing machine, Aquaguard, bed, cupboard, mattress, fixtures, and overall cleanliness.

NAVKAR ESTATES may deduct these amounts from the security deposit or recover separately.

I also acknowledge that NAVKAR ESTATES is not liable for: Natural calamities

Electrical failures Gas leaks Structural failures

Medical emergencies Self-inflicted harm

Illegal acts committed by Tenant or guests Any event beyond reasonable control
